Every rank-and-file employee in the Philippines is entitled to 13th month pay under Presidential Decree 851. It is your total basic salary for the calendar year divided by twelve — no more, no less. If you worked part of the year, you get a proportion of it.

[ QUESTIONS ]

Does overtime count?

No. PD 851 covers basic salary only. Overtime, night differential, holiday premium and cash allowances are excluded.

Do I still get it if I resigned mid-year?

Yes. You are entitled to a pro-rated amount for the months you actually worked, payable on separation.
